Welcome to STARKIDgift. These Terms of Use govern your access to and use of our website and the purchase of our personalized digital karaoke videos. By placing an order with us, you agree to these terms.

1. Our Services

STARKIDgift provides customized digital karaoke videos. We use the information and files you provide through our order forms to create a unique, personalized digital gift.

2. Product Creation (AI & Human Touch)

Our custom karaoke gifts are a unique blend of technology and human creativity. The custom audio tracks (music and vocals) are generated using advanced Artificial Intelligence based on your prompts, selections, or uploaded files. However, the video production, lyric synchronization, visual design, and final artistic editing are meticulously crafted by our human team to ensure the highest quality and a magical, personal touch for your child.

3. Ownership & Intellectual Property

We believe your gift belongs to you. Upon full payment and delivery of your custom karaoke video, you are granted full ownership and commercial/personal rights to the final delivered digital files (audio and video). You are completely free to download, share, post, and enjoy your custom creation with your friends and family. The original media files you provide us remain your sole property at all times.

4. User-Provided Content

For products like "Karaoke Your Song" that allow you to upload your own media:

• You are solely responsible for the audio or video files you upload.

• You guarantee that you have the right to use and share the uploaded files for this purpose.

• You agree not to upload any content that is offensive, illegal, explicit, or violates the rights of any third party. We reserve the right to cancel and refund any order that contains inappropriate material.

5. Payments and Billing

All transactions are securely processed by our Merchant of Record, Lemon Squeezy. By completing a purchase, you also agree to Lemon Squeezy’s terms of service. We do not store your credit card information on our servers.

6. Delivery and Refunds

• Delivery: We strive to deliver your personalized digital video to the email address provided within our stated turnaround time (usually 24 hours).

• Refund Policy: Because our products are 100% personalized and digital, all sales are final. We cannot offer refunds once the production process has started. However, if there is a technical error on our part (e.g., a spelling mistake in the child's name that differs from what you typed in the form), we will gladly fix the video and send you a corrected version free of charge.

7. Limitation of Liability

STARKIDgift shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our services, or from unauthorized access to your data, beyond the amount paid for the product.
